EB-2 NIW Requirements: 3-Prong Test & Costs for Engineers

Quick answer: EB-2 NIW is a green card category where USCIS waives the job offer and labor certification, so you can file the I-140 for yourself. Officers judge it with the three-prong Dhanasar test, and your wait after approval depends on the monthly Visa Bulletin.

Key takeaways

  • A national interest waiver lets you self-petition. No employer sponsor or PERM is required.
  • You must first qualify for EB-2, then pass all three Dhanasar prongs.
  • “I am a good engineer” is not the argument. Your specific endeavor and its national importance are.
  • Approval is only step one. The visa bulletin decides when you can take the next step.
  • Approval rates dropped as filings surged, so evidence quality matters more than ever.

What EB-2 NIW actually gives you

Normally EB-2 requires an employer to offer you a permanent job and complete PERM labor certification. The national interest waiver removes that, which is why engineers like it: you self-petition on Form I-140.

You still have to meet the EB-2 threshold first. Under USCIS’s Policy Manual chapter on EB-2, that means an advanced degree (or a bachelor’s plus five years of progressive experience) or exceptional ability. Foreign degrees may need a credential evaluation.

For engineers at Korean-affiliated companies, this matters because not every employer sponsors green cards. A self-petition doesn’t depend on your manager’s approval, although your work there is usually central to the evidence.

The three Dhanasar prongs

Since Matter of Dhanasar, USCIS judges every NIW petition on three questions. The January 2025 update to the Policy Manual added detail on how officers apply them.

  1. Substantial merit and national importance. Is your proposed endeavor valuable, with impact beyond one employer? For engineers, that often means battery manufacturing, semiconductors, grid storage, or automation work with broader industry effects.
  2. Well positioned to advance it. Do your education, record, and plan show you can move it forward? Think results, patents, publications, project leadership, and recognition from independent experts.
  3. Balance favors a waiver. Would the U.S. benefit from skipping the job offer and labor certification? Explain why your contribution is hard to capture through normal PERM.

The same guidance stressed that broad claims about helping the economy or creating jobs aren’t enough. Officers want a specific endeavor and specific proof, such as employment letters showing results, letters from independent experts, and evidence of adopted processes, cost savings, or yield improvements.

NIW works best for engineers who can back it up. I’ve seen several candidates in PLC, utilities and semiconductor roles file EB-2 NIW petitions and get their green cards. The ones without any certification related to their role were the ones who got denied.

NIW can also tip a hiring decision. In one case, a candidate on an E-2 visa was already moving forward with NIW and expected a green card within about a year, and that’s what got the transfer approved.

If NIW is on your mind, start collecting proof now: certifications, project results and letters from people who know your work.

Approval odds right now

Filings jumped from about 22,000 in FY 2022 to more than 66,000 in FY 2025, and law firms analyzing USCIS data report NIW approval rates fell from roughly 55% in FY 2025 to about 43% in the first quarter of FY 2026, according to VisaNation Law Group.

“Is NIW basically a coin flip now?”

Engineers ask me this a lot, usually right after a friend’s denial. USCIS’s own FY2026 I-140 data shows that from October 2025 through June 2026, USCIS approved 9,238 NIW petitions and denied 9,585, with 96,297 still pending. The April to June 2026 quarter looked better: 3,835 approvals and 3,103 denials.

So it’s close to even, which is a reason to build the case prong by prong instead of leaning on your job title. Not legal advice; every case is different.

  • Ask your attorney: “Which of the three prongs is my weakest, and what evidence fixes it?”
  • Ask before you sign: “What happens to my fee if this is denied?”

Timeline and the Visa Bulletin

Your place in line is your priority date, generally the date USCIS receives your I-140. Each month the State Department publishes the Visa Bulletin with Final Action Dates and Dates for Filing; when your date is earlier than the posted one for your category and country, you move to the next stage.

South Korea falls under Rest of World. In the October 2026 Visa Bulletin, EB-2 Rest of World retrogressed to a Final Action Date of January 1, 2025 and a Date for Filing of March 15, 2026. Dates move, sometimes backward, so check the current bulletin.

Mistakes that sink NIW cases

  • Describing a job, not an endeavor. “I work as a process engineer” is a role. Prong one needs a specific body of work with broader impact.
  • Letters that all sound the same. Templated letters from close colleagues tend to carry less weight than specific letters from independent experts.
  • Ignoring your current status. A pending or approved I-140 doesn’t by itself keep you in lawful status. Maintain your current visa.
  • Trusting “guaranteed approval” marketing. No one can promise an outcome.

Many Korean employers are building plants and R and D centers in batteries, semiconductors, and clean energy. See where that work is in Samsung, LG, Hyundai, and SK hiring in the U.S.

FAQ

Do I need my employer’s permission for EB-2 NIW?

No employer sponsor is required because you self-petition. Many people still tell HR, especially if they need employment verification letters.

Can I qualify with only a bachelor’s degree?

A bachelor’s plus five years of progressive, post-degree experience can count as an advanced degree equivalent. Exceptional ability is another route. An attorney can assess how your record fits.

Does an approved I-140 let me change jobs?

Because NIW isn’t tied to one employer, people often have more flexibility than with PERM. Your current visa status and any pending applications still matter, so get advice before switching.
